The DL Development in 2012 has led to ten years, the prescription of insurance policies dormant

Finally the battle of A.E.C.I. also shared by other consumers' associations brought some important innovations in the field of dormant policies: the Council of Ministers, in accordance with the Development Decree (Legislative Decree no. 179/2012) has indeed shown from 2 to 10 years the period of limitation policies life "dormant".

That period was reduced to 2 years with the Law n.166/2008 but, according to the same Government in a recent press, it was found wholly inadequate to ensure the possibility of redemption of the policy, especially in the case of dell'intestatario death.

The decree states that "in order to overcome possible unequal treatment of consumers in the field of life insurance policies, the co.2 art. 2952 of the Civil Code is replaced as follows: other rights under the contract of insurance and the reinsurance contract shall lapse ten years from the date on which occurred the event on which the law is based. "

The return of the limitation period to 10 years should give greater peace of mind to all those who until now had seen fade the possibility of ransom of his life insurance policy.

Meanwhile, it remains waiting to know the instructions for requesting repayment of the policies lapsed due to the previous legislation.

In short, to sum up by Decree Law no. 179 of 18/10/2012:

The Monti government within the Law Decree, amending Article 2952 Civil Code, has determined that the deadline for the limitation of rights arising out of contracts of insurance, and therefore also of the life insurance policies, changes from 2 to 10 years.

The measure came into force on 20/10/2012 and hence:

- Everything that has been prescribed by 19/10/2012 is required within 2 years;

- While anything that you would have to prescribe from 20/10/2012 prescribes after 10 years.

Therefore, the policies for which the accrued rights (expiry date, date left) or the last request for award came to the insurance company are dated:

- Up to 19/10/2010 are prescribed in 2 years

- From 20/10/2010 are prescribed in 10 years
